CodeFutures Corporation (dba "AgilData") ("AgilData") has created this Privacy Policy (this "Policy") to demonstrate its commitment to privacy. We recognize that the visitors to the AgilData website and subscribers and other users of the AgilData services care how their information is used and shared. This Policy describes the types of personal information we collect, how the information is used and the safeguards in place to protect that information. 

We may update this policy from time to time. The effective date noted below indicates the date that this Policy was last updated. Each visitor to the AgilData website or subscriber to the AgilData services is encouraged to click on the "Privacy Policy" link on our website frequently to determine if there have been any changes to this Policy.


Information you submit to us that identifies you or can be used to contact you (for example, your name, street address, telephone number, or email address) is your "personal information." This also includes identifiers that a governmental authority, financial institution or insurance carrier may use to uniquely identify you (for example, a Social Security, credit card or ACH account number). When we combine non-personal information with personal information, or non-personal information with other non-personal information in a way that renders the combined information personal information, we treat that combined information the same way we treat personal information.


AgilData may collect and store certain information automatically whenever you access AgilData website. The amount and type of information AgilData collects depends upon your use of the AgilData website. AgilData collects personal information about subscribers to the AgilData services in connection with the registration process when you establish a user account for AgilData services. This information includes names, street addresses, email addresses, telephone numbers, billing, payment, usage, credit card and transaction information, as well as demographic information.   In addition, AgilData collects personal information that a visitor to the AgilData website voluntarily submits to us in the "Contact Us" section of our website or in response to promotional campaigns we may undertake.

A non-subscriber may browse the AgilData website without providing personal information. However, AgilData passively collects non-personal information that is automatically sent by your web browser. This information typically includes your domain name and Internet Protocol (IP) address, but may contain additional information depending on your web browser settings. Each time you visit the AgilData website, AgilData may count, track and aggregate the visitor's activity for analysis of general traffic flows at the AgilData site. This information may also captured using automated tracking technologies such as browser cookies and web beacons (as described in more detail below), and may also be collected through the use of third party tracking services (such as Google Analytics) that collect data in aggregate (such as number of visits to a particular page, or the amount of time spent on a website).


AgilData may use "cookies", which are files stored on your computer's hard drive by the browser. These cookies help AgilData to (i) identify and authenticate visitors and subscribers, (ii) store preferences, (iii) tailor content and advertisements on the AgilData website and AgilData services according to user or subscriber preferences, (iv) preserve session settings and state, (v) automatically fill in forms and sign-in screens, and (vi) analyze the performance of the AgilData services. The cookie does not contain any personal information but does identify the specific installed program you use to browse the AgilData website. Most browsers accept cookies automatically but allow a user to disable them. If cookies are disabled, you may not be able to take full advantage of a personalized experience on the AgilData website or the AgilData services.

Web beacons are small strings of code that deliver a graphic image on a web page or in an email message for the purpose of transferring data back to us. The web beacon does not transfer any personal information, but the information collected via web beacons may include your IP address as well as information about how you respond to an email campaign (for example, the time the email is opened, where does the user link to from the email, etc.).  


We do not sell to others any personal information that may be provided to us through the AgilData website, unless it is with consent as otherwise described in this Policy. We do not sell or share personal information with third parties for their own marketing uses.  However, we may share your personal information with AgilData's suppliers, business associates or service providers if necessary for these companies to provide products or services to us.  We have written agreements that require these third parties to use the same level of protection for your information as provided by AgilData under this Policy. In addition, if a third party acquires AgilData or all or a substantial part of its business assets, personal information may be included as part of that sale.

From time to time, AgilData may sponsor promotional events that may require the collection, processing and storing of individual contact and demographic information to be used for the event. We may also co-sponsor activities with other persons or organizations, in which case individual contact and demographic information is likely to be shared with the other participating sponsors. Although we may request that co-sponsors of such events uphold the privacy of the information, AgilData has no liability or responsibility where the co-sponsors do not comply with any requests by AgilData.


AgilData may use personal information for the following purposes:

We use contact information for potential customers or persons seeking information (for example, personal information you voluntarily provide in connection after clicking on the "Contact Us" link on the AgilData website) to enable AgilData to contact those persons to provide information about AgilData's products and services and to respond to inquiries and communications about the AgilData website or AgilData services.

We may use contact information, such as your name, address, telephone number, or email address submitted by subscribers to provide additional information regarding the AgilData services or other products and services, including new features, functionality, new products and services that AgilData may introduce from time to time, upcoming events, and new features of the AgilData website.

We may use both personal information and non-personal information to administer the AgilData services and, if applicable, your subscriber account, including processing registrations and payments and providing customer support. In addition, we may use certain personal information about our subscribers to provide the AgilData services.  For example we use our subscriber's email address to deliver messages that are sent as part of the AgilData services

      We may also use non-personal information that we collect through the automated tracking technologies described above to improve and personalize your experience on our website. Based on this type of information, we may also show you specific AgilData content or promotions that are tailored to your interests. 

      We may use personal information and non-personal information for other general business purposes, such as to maintain the day-to-day operation and security of our website and to conduct internal marketing and demographic studies. In addition, we may use non-personal information for any purpose not prohibited by law, including aggregating such information, which may be provided to advertisers or other partners or used for our general business purposes.

      AgilData may release personal information if (i) it believes in good faith that it is required by law or legal process, (ii) it is required by a law enforcement agency that has provided a valid request, (iii) it is necessary to enforce our Terms of Services applicable to the AgilData services, the AgilData website and AgilData application software, (iv) it is required to safeguard and protect the rights of our other subscribers and other third parties, or (v) it is required to protect our rights or such release is necessary to protect the rights, property or safety of AgilData, its subscribers or others.


The AgilData website and the AgilData services (including email messages that we send to our subscribers in connection with the AgilData services) may contain links to other websites. AgilData is not responsible for the privacy policies applicable to other websites or how they may treat information about their users. Advertisers on the AgilData website, or other websites to which you link, may have the ability to assign cookies in a process not under our control.


The AgilData services and the AgilData website are not suitable for use by minors. Accordingly, AgilData does not market to anyone who is known to AgilData to be under the age of 18, nor is any personal information collected from anyone who is known to AgilData to be under the age of 18.


The AgilData website provides visitors with the ability to correct information they have provided to AgilData through the AgilData website administrator. Please send your corrections or updates to <>.


The default assumption is that you have "opted-in" and consented to use of your information as set forth in this Policy. If you no longer wish to receive promotional information from AgilData, you may request that AgilData cease further contact at any time by sending an email request marked "Privacy-Urgent" to <>. Participants may also choose to opt out in the event AgilData indicates that their personal information will be disclosed to a third party or used for a purpose incompatible with the purpose for which it was originally collected, or not subsequently authorized by those participants. We will use commercially reasonable efforts to delete such information from our internal databases. Please be aware, however, that while you are a subscriber to the AgilData services, you will not be able to opt-out of our use of your information that is necessary for us to provide the AgilData services or administer your user account. 


We take reasonable and industry standard security measures and procedures to protect personal information under our control from loss, misuse or alteration. However, you should be aware that no data transmission over wireless networks or over the Internet is completely secure. Also, to protect your personal information you should take all appropriate steps to safeguard your passwords and account information, including your AgilData subscriber account information. If you become aware of any loss, theft or unauthorized use of your password our subscriber account information, please notify us immediately by sending an email message to <>.
